These Terms of Service ("Terms") govern your access to and use of the website, products, and services ("Services") operated by Synergon AI Private Limited("Synergon AI"). By using our Services, you agree to be bound by these Terms.

1. Use of Services

Synergon AI provides an AI-powered platform for business automation. You may use the Services only if you can form a binding contract with Synergon and are not a person barred from receiving services under the laws of the applicable jurisdiction.

Account Registration: You must provide accurate and complete information when registering for an account.
Authorized Users: You are responsible for all activity that occurs under your account.

2. Acceptable Use Policy

You agree not to misuse the Services. In particular, you shall not:

Use the Services for any illegal or unauthorized purpose.
Generate or distribute content that is harmful, offensive, or violates third-party rights.
Attempt to bypass security measures or reverse engineer our AI models.
Use automated systems (bots, scrapers) to access the Services without authorization.
Input personal data of others without a valid legal basis or consent.

3. AI-Specific Terms

Our Services utilize artificial intelligence technology. You acknowledge that:

Output Variability: AI-generated content may vary and should be reviewed for accuracy before use.
Model Propriety: Synergon retains all rights to its proprietary AI architectures and algorithms.
No Scraping: You may not use the Services to "scrape" data for the purpose of training competing AI models.

4. Third-Party Messaging Platforms

Synergon delivers messages through platforms we do not own — including WhatsApp and Instagram, operated by Meta. Using those channels through Synergon means you also agree to the platform's own terms.

Platform Terms: Your use of WhatsApp through Synergon is subject to Meta's WhatsApp Business Terms of Service and the WhatsApp Business Messaging Policy, in addition to these Terms. The same applies to Instagram and any other messaging channel you connect.
Your Content and Consent: You are responsible for the messages you send and for holding the recipient consent those platforms require. You must honour opt-out requests, and we maintain a do-not-contact list on your behalf to help you do so.
Platform Decisions Are Not Ours: Messaging limits, quality ratings, template approvals, phone number restrictions and account suspensions are determined by the platform, applying its own policies. We cannot overturn them, and we are not liable for a platform's decision to restrict or suspend your account or your messaging.
Changes by the Platform: Platforms change their terms, pricing and capabilities on their own schedule. Where that changes what Synergon can deliver, we will tell you, but we cannot guarantee continuity of a third-party channel.

5. Service Level and Support (SLA)

We aim for a high level of availability (99.9% uptime for enterprise customers). However, we do not guarantee that the Services will be uninterrupted or error-free. Maintenance windows will be communicated in advance whenever possible.

6. Intellectual Property

Synergon Intellectual Property: All rights to the Services, including software, branding, and AI models, remain with Synergon.
Customer Content: You retain ownership of the data you input. You grant Synergon a license to process this data solely for providing the Services.

7. Limitation of Liability

To the maximum extent permitted by law, Synergon shall not be liable for any indirect, incidental, or consequential damages, including loss of profits or data. Our total liability for any claim arising out of these Terms shall not exceed the amount paid by you to Synergon in the 12 months prior to the claim.

8. Termination

We may suspend or terminate your access to the Services at any time for violations of these Terms. You may terminate your account by contacting support or through your dashboard settings.

9. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore.
